ORDER OF THE BOARD (by R.C. Flemal):
This matter comes before the Board on a motion and status
report. On July 22, 1994 St. Louis Auto Shredding (SLAS) filed a
motion to dismiss its appeal in docket PCB 93-46. SILAS states
that the Illinois Environmental Protection Agency (Agency) has
issued a permit for significant modification to SLAS on July 8,
1994. Consequently, SLAS’s appeal of the Agency’s denial of
SILAS’s application for a modified landfill permit, the subject of
the appeal in PCB 93-46, is now moot. The Board hereby grants
the motion and dismisses the appeal in PCB 93-46 and closes that
docket.
Also on July 22, 1994 SLAS and the Agency filed a status
report in PCB 93-45. SLAS states that discussions are continuing
in this docket concerning the modified closure plan for the
existing landfill. The Agency and SILAS anticipate that they will
reach an agreement about SLAS’s closure plan in the near future
and ask that a new status date be set.
The parties shall submit status reports in docket PCB 93-45
to be received by the Board and hearing officer no later than
September 12, 1994.
