ORDER OF THE BOARD

On July 20,
1994,
the Illinois Environmental Protection
Agency (Agency) filed a motion for further extension of time to
respond to the petitioners’ request for an adjusted standard.
The Agency was required to respond to the petition by April 25,
1994,
but was granted two prior extensions until May 13,
1994 and
until July 15,
1994.
The Agency states that subsequent
discussions had been had with petitioners.
The Agency reports
that petitioners have agreed to supplement the record in this
proceeding within 30 days.
The Agency believes that the
incorporation of this additional information will improve the
quality of the Agency’s response.
The Agency requests an
extension of 30 days from after the record is supplemented by the
petitioners in which to file its response.
The Agency has not specified a date certain for the filing
of its response but requests that an extension be granted for 30
days after petitioner has supplemented the record.
The Board
refuses to grant an extension for an indefinite period.
The
Board will grant the Agency an extension until September 30,
1994,
in which to file its response to the petition for adjusted
standard.
The Board notes that related permit appeals
(PCB 91-28 and
PCB 92-2)
are stayed pending resolution of this adjusted
standard.
Petitioner is ordered to file any supplemental
information to be considered by the Agency by August 26,
1994.
