    This matter is before the Board
    pursuant to a
    status
    report filed by
    Quantum
    Chemical
    Corporation, USI Division
    (Quantum)

    The status
    report was filed in
    response to our order of June 2,
    1994.
    The status report indicates negotiations are
    proceeding
    in
    related case PCB 93-173, and
    a joint
    status report has been filed in
    that matter.
    That status report indicates that
    Quantum recently filed a request for modification of its
    NPDES
    permit,
    a grant of which
    would
    likely
    render both
    the permit appeal
    and
    this
    proceeding
    moot.
    Quantum asks
    that
    the
    stay of this
    matter be
    extended
    through November
    17,
    1994
    since the review period
    for the NPDES
    permit
    modification request
    is
    90
    days.
    Having
    received
    no
    response to the
    motion from
    the Agency, we hereby
    grant the motion to
    stay
    until November
    17,
    1994.
    Quantum
    is directed
    to
    file an
    additional
    status report
    on or
    before November
    17,
    1994,
    indicating
    the status of any
    on-going
    negotiations.
    If the
    negotiations result
    in
    the Agency granting the NPDES
    permit,
    Quantum may instead
    file a
    motion
    to
    withdraw the petition for an
    adjusted standard.
