On July 12,
1994,
the Appellate Court of Illinois, First
District issued a mandate which reverses and remands the Board’s
February 4,
1993 opinion and order
in this proceeding.
The
Board’s February 4,
1993 opinion and order had affirmed the
Agency’s denial of eligibility for a reported release from
underground storage tanks owned by Chemrex.
The First District
remanded the case for “further proceedings not inconsistent with”
the First District’s opinion.
The Board is today requesting that the parties file with the
Board no later than September 9,
1994 their views regarding what
proceedings are appropriate
in this case at this time.
