ORDER OF THE BOARD
(by R.C. Flemal):
On February 23,
1994 LTV Steel Company
(LTV)
and the
Illinois Environmental Protection Agency (Agency)
filed a joint
status report.
LTV also filed a motion that the report be
accepted instanter,
stating
inter alia
that negotiations delayed
the filing of this report.
The Board grants the motion to file
instanter.
The parties state that LTV’s thermal study has been
performed and reports prepared.
LTV
and its engineers have
submitted the reports to the Agency along with a draft petition
for adjusted standard.
The Agency has recently completed its
review and sent comments to LTV’s counsel in correspondence dated
January 21,
1994.
LTV asks that the matter be stayed for another
60 days pending the filing of a petition for adjusted standard
regarding the thermal discharges.
LTV expects to file the
adjusted standard within 30 days of receipt of the Agency’s
comments on the petition.
An open waiver was previously filed in
this proceeding.
The Board finds that the status report indicates sufficient
progress toward resolution of this proceeding.
The Board grants
the motion to stay and directs the parties to file a status
report with the Board and hearing officer not later than May 6,
1994.
