This matter comes before the Board upon a third agreed

motion to “Extend or Stay the Briefing Schedule” filed September

2,

1994.

The motion asks that the petitioner be granted an

additional 28 days to respond to the motion to reconsider filed

by the Agency.

The motion states that a settlement of the issues

appears to have been reached; however, the petitioners attorney

has not been forwarded a copy of the settlement and will be on

vacation through September 16,

1994.

The Board grants the motion

and petitioner’s response to the motion for reconsideration is

now due on October

6,

1994.
