ORDER
OF THE BOARD

This matter is before the Board on a joint status report
filed February 16,
1994 by the parties to this five—year-old
permit appeal.
In the report, the parties indicate they have
agreed on a means of resolving the RCRA permit appeal.
Olin has
agreed to request a permit modification and also agreed that
concurrent with the permit modification request,
it will amend
its Part B application to conform to the most recent Agency
Guidance document and update the application to incorporate all
modification since the permit application was filed in November,
1990.
Olin and the Agency represent that the changes in the
revised application are lengthy and detailed, and therefore
completion of the revised application and the concurrent permit
modification request have been delayed. Moreover, the parties
expect to resolve any remaining issues by mutual agreement and
that a final Part B permit will be issued, resulting in dismissal
of this appeal.
The Board finds the status report acceptable.
In that a
decision deadline waiver until May 1,
1995 has been filed,
parties are directed to file an additional status report either
on or before Monday, July 25,
1994,
or within 14 days after the
final Part B permit is issued, whichever comes first.
On February 16,
1994, Amy L. Wache,
counsel on behalf of
Olin filed a motion for leave to appear before the Board in this
matter.
Ms.
Wachs is a partner in the law firm of Husch
&
Eppenberger of St.
Louis, Missouri and is licensed to practice in
the State of Missouri.
Pursuant to 35 Ill. Adm. Code Section
101.107(b), the motion is hereby allowed, and Ms. Wachs
is
granted leave to appear before the Board in this matter.
