ORDER OF THE BOARD

This matter is before the Board on its
own
motion.
On June
21,
1993,
the Board held a hearing in this matter.
At hearing,
counsel for the Illinois Environmental Protection Agency
(Agency)
submitted a joint motion for continuance, stating that petitioner
Safety-Kleen had filed both parts of its RCRA Part B application
with the Agency, and that the Agency anticipated issuing a draft
permit “later this month”.
The Agency attorney stated that the
parties anticipated that Safety-Kleen would be able to dismiss
this matter in 90 days.
The hearing officer and the Agency
attorney then agreed that there would be a conference call
between the parties and the hearing officer in 60 days.
However,
no further action has been taken in this case.1
The Board directs Safety-Kleen and the Agency to file status
reports
(or a joint status report,
if the parties prefer),
setting forth the anticipated date of resolution of this matter.
That status report or reports shall be filed with the Board no
later than March
9,
1994.
IT IS SO ORDERED.

On November 19,
1993, the parties filed a document
entitled “Joint Motion for Continuance of Hearing” in this case.
However, no hearing was scheduled in this case,
and therefore no
ruling on this motion is necessary.
We note that there was a
December
6,
1993 hearing scheduled in another appeal brought by
Safety-Kleen.
