ORDER OF THE BOARD

On August 24,
1994,
Burlington Environmental Inc.
(Burlington)
filed a comment concerning the necessity of this
rulemaking considering the proposed identical—in—substance
rulemaking in R94-17 as requested by the Board’s order of July
21,
1994.
Burlington agrees that the language of the proposed
identical—in—substance rulemaking is equivalent to the language
requested in this rulemaking.
Burlington also agrees that the
identical-in—substance rulemaking presents
a streamlined and
expedited method of revising the exclusion limits.
However,
Burlington requests that this matter not be dismissed as
“unnecessary”.
Burlington requests that the Board extend the
stay in this matter until the completion of the identical in
substance rulemaking.
The Board grants an extension of the stay in this matter.
As the Board does not favor indefinite stays,
the Board will
grant a stay in this matter until January
3,
1995.
The Board
believes that this provides adequate time for the completion of
the identical-in-substance proceeding and for Burlington to
determine how to proceed with this rulemaking.
The Board also
orders Burlington to provide the Board with a status report on
January
3,
1995.
