ORDER OF THE BOARD (by E. Dunham):

Pursuant to the Board’s order of November 18, 1993, LTV

filed a status report in this matter on February 1, 1994. LTV

also provided a waiver of the decision deadline until September

5, 1994.

The status report states that petitioner and respondent have

held a series of discussions concerning the inclusion of the

groundwater monitoring requirements in the permit that is the

subject of this appeal. Agreement has been reached on that issue

and the monitoring plan is undergoing final approval. Once

approval is received, LTV will dismiss this appeal.

Petitioner is directed to file an updated status report on

or before May 13, 1994, in the event that this appeal has not

previously been dismissed.
