On November
8,
1991,
General Motors Corporation, Powertrain
Division
(“GM”),
filed
a permit
appeal challenging the Illinois
Environmental Protection Agency’s final determination issuing GM an
NPDES permit on October
9,
1991.
The petition was accepted for
hearing on November 21, 1991, and the assigned hearing officer set
this matter for hearing on September 24, 1992 and, subsequently, on
July 8, 1993; both hearing dates were cancelled, and as of the date
of this order, no hearing has yet been held.
On June 22, 1993, the
parties
filed
a
Joint
Motion
for Continuance
of Hearing
for
a
period of six months so they may pursue negotiation.
The parties are hereby directed to file a status report with
the Clerk of the Board and the assigned hearing officer in this
case on or before February 24,
1994.
The parties should indicate
the
status
of
any
on-going
negotiations,
whether
the
parties
anticipate reaching settlement in this matter and if possible,
a
projected timeline for completion of settlement.
If the parties
expect that a hearing will be necessary, they should also include
this information.
Should a hearing become necessary, the hearing
officer will contact the parties to set a hearing schedule.
