ORDER OF THE BOARD

On January 28,
1994,
petitioner Acme Steel Company
(Acme)
filed a status report in this proceeding.
This status report is
in response to a November 4,
1993 Board order, directing Acme to
file a status report by January 15,
1994.
We note that Acme did
not include a motion for leave to file this report
instanter,
but
we will accept the status report in the interests of taking
further action on this case.
Acme again states that it is working with the Illinois
Environmental Protection Agency (Agency)
in pursuing permanent
relief from the standards at issue in these appeals.
Acme states
that it has prepared a draft petition for adjusted standard and
supporting documentation, which Acme submitted,
in November, to
the Agency for review.
Acme states that the Agency recently
completed its review of those materials and sent comments to Acme
in a January 21,
1994 letter.
Acme estimates that it is prepared
to file the petition for adjusted standard with the Board within
30 days.
Acme recommends that this matter be stayed for 60 days
pending resolution of the adjusted standard petition.
The Board points out that this case was begun in 1991,
and
that we cannot continue to allow the case to linger indefinitely.
Acme is directed to file an updated status report no later than
March 25,
1994.
