ORDER OF THE BOARD

On October 6,
1994, petitioners filed a joint motion for
rehearing and reconsideration.
On October 19,
1994,
the Illinois
Environmental Protection Agency responded in opposition to the
motion to rehear.
The motion asks the Board to reconsider its
order of September
1,
1994, wherein petitioners’ permit appeal
was dismissed.
The Board’s rules at Section 101.246(d)
states that the
Board will consider factors including, but not limited to “error
in the decision and facts
in the record which are overlooked”.
(35 Ill.
Adm. Code 246.)
The Board has reviewed the motion and
finds that petitioners have failed to identify any error
in the
Board’s original decision and have presented no new facts or
arguments.
Therefore,
the motion for reconsideration is denied.
