On October
6,
1994 the Board directed Citizens Utilities
Company of Illinois
(Citizens)
to file an updated
status
report
on or before October 17,
1994.
The Board received Citizens’
status report on October 11,
1994.
In the status report,
Citizens requests that the Board extend the stay in this matter
for an additional 90 days in order to allow Citizens and the
U.S.EPA time to complete settlement negotiations regarding a
federal enforcement action. If the tJ.S.EPA and Citizens are able
to reach a settlement in the federal action, this rulemaking, the
related variance case, PCB 85—95,
and a pending permit appeal,
PCB 85-166 may be resolved and thus, withdrawn.
Accordingly, Citizens is granted an extension of the stay
for an additional 90 days.
Citizens
is directed to file a status
report on or before January
6,
1995.
Again,
the report shall
indicate the status of the negotiations with the U.S.EPA, whether
additional time will be required to complete negotiations,
or
whether it will be necessary to proceed with this rulemaking.
Citizens shall file an appropriate motion withdrawing the
petition for a site-specific rule in the event that settlement is
reached sooner than anticipated.
