ORDER OF THE BOARD (by Mr. Dumelle):

On December 7, 1979 Petitioner requested a

variance

from the ammonia nitrogen limitations in NPDES Permit #IL

0052621. The Petition is deficient in several respects.

First, it fails to state whether relief is sought from a

monitoring requirement or an effluent limitation as required

by Procedural Rule 401(a)(1). Second, it fails to describe

the extent of Petitioner~s inability to meet its

present

NPDES limitations and to explain why compliance cannot be

achieved as required by Procedural Rule 401(a)(5), Third,

it fails to describe a compliance program as required by

Procedural Rule 401(a)(6), Fourth, it fails to list

Petitioner~s past efforts toward compliance as required

by

Procedural Rule 401(a)(8). Fifth, it fails to discuss

alternate methods of compliance as required by Procedural

Rule 401(a)(9).’ Sixth, it fails to specifically

request or

waive a hearing as required by Procedural Rule 401(b).

Consequently, this matter is hereby dismissed without

prejudice.
