ORDER OF THE BOARD

On August 25,
1994 pursuant to Board order, the parties
filed
a joint status report.
This matter is an appeal by Olin
Corporation
(Olin)
of the Illinois Environmental Protection
Agency’s
(Agency) rejection of a clean closure plan for a waste
cyanide storage area and a modified closure/post—closure plan for
waste ballistics sand storage areas at Olin’s East Alton
manufacturing facility.
The parties report that they have been
actively pursuing settlement and that they have agreed in
principle to coordinate the closure of the ballistics sand
storage units with the RCRA Facility Investigation planned as
part of the facility’s RCRA Part B permit.
The parties also
state that pursuant to settlement discussions,
on September 7,
1993 Olin has submitted to the Agency a modified closure/post—
closure plan for the ballistics storage areas.
In previous status reports, the parties represented that a
certificate of clean closure for the waste cyanide storage area
was previously submitted to the Agency.
The parties have
recently realized that what was actually submitted was a request
to accept clean closure of the cyanide storage area along with
supporting documents.
The Agency has reviewed and approved that
request.
Pursuant to that approval, Olin submitted a Closure
Certification Statement to the Agency for the waste cyanide
storage area on August 10,
1994.
The parties state that the
Agency will approve the cyanide pad closure certification,
subject to inspection.
Inspection was conducted on August 18,
1994 and the report has not yet been completed.
The parties have agreed to the terms of a draft settlement
letter, and are very close to final agreement.
If agreement on
closure of each unit is reached, Olin will move for dismissal of
this matter.
Olin also has waived the decision deadline until
June
1,
1995.

The parties are ordered to file a status report in this
matter on or before December 29,
1994
in the event this appeal
has not been dismissed.
