    ORDER OF THE BOARD
    (by J. Yl):
    On August 24,
    1994,
    the Bargain Auto Rental Inc.,
    an
    Illinois corporation
    (Bargain Auto), filed a Petition for Review
    of Denial of UST Fund Eligibility by the Illinois State Fire
    Marshal
    (OSFM).
    On July
    15,
    1995,
    OSFM had classified the
    release at Bargain Auto’s facility as “minor”
    which
    makes the
    site ineligible for reimbursement from the UST Fund.
    On February 15,
    1995, Bargain Auto filed a voluntary motion
    to dismiss its petition.
    The motion states that since the filing
    of the petition,
    OSFM and the Illinois Environmental Protection
    Agency are now allowing sites with “minor” releases to access the
    UST fund for reimbursement of eligible corrective action costs.
    In addition, the motion states that OSFM will reconsider Bargain
    Auto’s eligibility to access the UST Fund and issue a new
    determination of eligibility.
    The motion to voluntarily withdraw
    the petition is granted and the docket in this matter
    is closed.
