ORDER OF THE BOARD
(by C.A. Manning):
On January
19,
1993, the U.S. Department of the Army
(Department),
filed an amended petition for review of the
Illinois Environmental Protection Agency’s (Agency) denial of its
Resource Conservation and Recovery Act
(RCRA)
Part B permit.
The
Department filed a waiver of the statutory decision deadline on
January 26,
1993.
The Department’s most recent status report
filed on July 14,
1994,
stated that it was attempting to resolve
the matter without proceeding to hearing and that upon Agency
approval of
a closure plan for the facility it would withdraw its
permit appeal petition.
Based on this status report,
on July 21,
1994, the Board directed the parties to file individually or
jointly an updated status report on or before September
9,
1994
if the Department’s motion to withdraw this permit appeal was not
received.
On October
6,
1994, the Board directed the parties to file
an updated status report or a motion to withdraw the permit
appeal on or before October 28,
1994.
On October
31,
1994 the
Board received an updated status report from the Department.
This status report states that the Agency has approved its
closure plan and the Department is in the process of closing its
facility.
However, the Department states that due to contracting
problems final closure is not expected for another 90 to 120
days.
Finally, the status report concludes by stating that once
final closure is completed the Department will withdraw its
appeal.
The parties are directed to file an updated status report,
jointly or individually,
on or before February 3,
1995.
If in
the event that final closure is completed before February 3,
1995, the Department shall file the appropriate motion at that
time.
