    COMPANY FOR ADJUSTED

    (Adjusted Standard)
    FROM 35 ILL.
    ADM.
    CODE
    )
    PART 218
    )
    ORDER OF THE BOARD
    (by J. Theodore Meyer):
This matter is before the Board on a petition for adjusted
    standard,
    filed on December 5,
    1994 by Central Can Company
    (Central Can).
    On December 28,
1994, Central Can filed its proof
of publication of notice of the petition, pursuant to 35 Ill.
    Adm. Code 106.711.
The Board finds that the petition does not satisfy all of
the informational requirements set forth in 35 Ill. Adm. Code
    106.705.
The petition is insufficient in the following respects:
    1.
    Although
    the
    petition
    discusses
    a
    number
    of
    regulations in 35 Ill.
    Athn. Code Parts 211
    and 218,
it is not clear exactly which
regulations are the subject of its request
    for relief.
    The petition must include the
    Administrative Code citation to the
regulations from which an adjusted standard
is sought, and the effective date of those
    regulations.
    (Section 106.705(a).)
    2.
The petition lacks a discussion of the
    qualitative
    and
    quantitative
    nature
    of
emissions currently generated by the Central
    Can’s facility.
    (Section 106.705(d).)
    3.
The proposed language for the adjusted
standard must clearly identify the rule(s)
    of
general applicability from which the proposed
adjusted standard is to be granted.
    (Section
    106.705(f).)
    4.
The petition does not sufficiently address
the impact of the activity on the environment
if Central Can were to comply with the rule
of general applicability, as compared to the
impact on the environment if Central Can were
to comply with the proposed adjusted
    standard.
    (Section 106.705(g).)
Central Can shall file, no later than February 25,
    1995, an

    2
    amended petition addressing these issues.
    Failure to timely file
an amended petition will subject this proceeding to dismissal.
    IT IS SO ORDERED.
