BOARD

This

matter comes before the Board pursuant to an Illinois

Environmental Protection Agency (Agency) Motion for Extension of

Time to File Agency Recommendation,

filed December 13,

1994.

Pursuant to 35 Ill. Adm. Code 106.714, the Agency is to file a

response to the petition within 30 days of the filing of the

petition.

The City of Wood River filed the petition on October

27,

1994, therefore the Agency recommendation should have been

filed on November 26,

1994.

The Agency requests an extension

until December 28,

1994 to file its recommendation,

in order to

complete

review

of

the

petition.

The

Board

hereby

grants

the

Agency

an

extension.

However,

the

Board

to

date

has

not

received

the

recommendation

from

the

Agency.

The Board directs the Agency to file the recommendation

by

January

20,

1995.

On

December

16,

1994,

the

City

of

Wood

River

filed

a

motion

for waiver of hearing.

The Agency filed a response to

petitioner’s

request

for

waiver

of

hearing,

stating

that

it

has

no

objection to the waiver of hearing.

Since no request for

hearing

has

been

received

by

the

Board

and

the

Agency

has

no

objection to the waiver of the hearing, the Board grants the

request for waiver of hearing.

The Board rescinds its order of

December

1,

1994 to the extent that it ordered this matter to

hearing.
