ORDER OF THE BOARD
(by N. NcFawn):
On November 3,
1994, the Illinois Environmental Protection
Agency
(Agency) filed a motion for extension of time to file the
Agency recommendation in this matter.
The Agency sought to
extend the deadline for filing its recommendation in this case
from November 7,
1994 until November 28,
1994.
On November 22,
1994, the Agency filed a second motion,
seeking to further extend
the deadline for filing its recommendation until December 19,
1994.
In support of its November 3,
1994 motion, the Agency stated
that its technical staff had not yet completed the technical
analysis necessary for preparing its recommendation,
and that the
personnel necessary to perform this analysis would be unavailable
until November 7,
1994.
In its November 22,
1994 motion, the
Agency asserts that the technical personnel responsible for
preparing the technical analysis will be unavailable for health
reasons, and that it is necessary to seek technical assistance
from other personnel.
The Agency further asserts that no one
will be prejudiced by this extension,
since petitioner has waived
the decision due date until May 19,
1995.
The Agency’s motion for extension of time to file the Agency
recommendation is hereby granted.
The recommendation is now due
on or before December 19,
1994.
IT IS SO ORDERED.
