ORDER OF THE
BOARD
(by J. Theodore Meyer):
This matter is before the Board a November 22,
1994,
joint
motion to stay.
The petitioner, the Galesburg Sanitary District
(District)
and the respondent, the Illinois Environmental
Protection Agency (Agency), request that the Board stay this
matter for six months.
The Board will not grant the stay for six months because the
decision date for this matter is April 20,
1995,
and the Board
cannot grant such a lengthy stay without a waiver.
In addition,
the parties are requesting the stay based on the petitioner’s
anticipated filing of an adjusted standard with the Board before
the end of the year.
The Board will not grant the requested stay
based upon conduct that may occur at some unknown time in the
future.
However, the Board will grant the stay until the January
12,
1995 Board Meeting and directs both the District and the
Agency to file status reports
(or a joint report,
if the parties
prefer) to be received by the Board no later than January 6,
1995.
The Board also reminds both parties that the hearing
officer must also be served with all motions and status reports.
