    ORDER OF THE BOARD

    Pursuant to hearing officer order of October
    20,
    1994
    petitioner was required to have filed its brief by March
    1,
    1995
    and respondent was to have filed its brief by March
    15,
    1995.
    Neither filing has occurred.
    Petitioner and respondent are
    accordingly in default of the hearing officer order.
    Pursuant to petitioner’s waiver of deadline for decision,
    as
    filed on October 18,
    1994, this matter is due for final decision
    no later than April 20,
    1995.
    In consideration thereof,
    and in
    consideration of the Board’s need for time to deliberate over a
    closed record,
    the parties are hereby given notice that the Board
    will not now accept briefs in this matter.
    The Board accordingly
    will proceed to decision by April 20,
    1995 based upon the record
    as it now stands, absent the benefit of briefs.
