OPINION

AND

ORDER OF THE BOARD

The Board is amending the pretreatment regulations pursuant

to Section 13.3 of the Environmental Protection Act

 (Act)

 (415

ILCS 5/13.3

 (1992)).

Section 13.3 of the Act requires the Board to adopt

regulations which are “identical in substancelt with federal

regulations promulgated by the United States Environmental

Protection Agency

 (U.S.

 EPA) to implement the pretreatment

requirements of Sections 307 and 402 of the Clean Water Act,

previously known as the Federal Water Pollution Control Act.

Section 13.3 provides that Title VII of the Act and Sections 5

and 6.02 of the Administrative Procedure Act

 (APA)

 shall not

apply to identical in substance regulations adopted to establish

the pretreatment program.

 However, Section 13.3 of the Act does

require the Board to provide for notice and public comment before

rules are filed with the Secretary of State.

This rulemaking updates the pretreatment rules to cover U.S.

EPA rules adopted from July

 1 through December 31,

 1993.

The pretreatment rules govern discharges by industrial users

to publicly owned treatment works

 (POTW5).

 The rules are

intended to prevent pollutants from industrial discharges from

passing through POTWs, without adequate treatment, to waters of

the State, and to prevent industrial discharges from interfering

with the operation of the treatment plant.

 Effluent discharges

are regulated pursuant to 35 Ill.

 Adm. Code 304 and 309.

The Illinois pretreatment rules are contained in 35 Ill.

Adm. Code 307,

 309 and 310.

 Part 307 includes the categorical

pretreatment standards, which are incorporated by reference from

the U.S. EPA rules.

 Part 309 sets forth the NPDES requirements.

Although Part 309 does not pertain directly to sewer users and

industrial wastewater pretreatment,

 it includes requirements at

Section 309.103 that pertain to NPDES permittees required to have

an approved pretreatment program.

 Part 310 specifies how a POTW

sets up a pretreatment program, and how industrial users get

pretreatment permits or authorizations to discharge.

PUBLIC COMMENTS

The notice of proposed amendments for this rulemaking

appeared in the Illinois Register on March 10,

 1995 at 19

 Ill.

Req.

 2612.

 The publication in the Illinois Register opened a 45

day public comment period.

 Public comments in this matter were

to be filed with the Board by April 24,

 1995.

Two public comments were received by the Board during the

public comment period.

 A public comment was received from the

Index Department of the Administrative Code Division of the

Office of the Secretary of State.

 This comment stated that the

proposed amendments complied with the codification requirements.

The Illinois Environmental Protection Agency filed a public

comment in support of adoption of the proposed regulations.

The

Agency stated that adoption of the regulations is necessary for

the completeness of the state regulatory program.

The Board will adopt the amendments as proposed for public

 comment updating references to the CFR to the 1994 edition.

The Board will delay filing any adopted rules with the Secretary

of State for

 30 days after adoption, particularly to allow U.S.

EPA review.

 The complete text of the adopted amendments follows

the discussion of the amendments.

DISCUSSION

SUBPART 0:

 ORGANIC CHEMICALS, PLASTICS AND SYNTHETIC FIBERS

On June 29,

 1990 at 55

 Fed.

 Reg.

 26692, U.S. EPA amended a

number of sections in 40 CFR 414

 (the Organic Chemicals, Plastics

and Synthetic Fibers Category)

 in response to a federal judicial

remand in Chemical Manufacturers Association v.

 EPA,

 870 F.2d 177

(5th Cir.

 1989).

 U.S. EPA withdrew the limitations subject to

the remand.

 The Board similarly withdrew these limitations in

R91—5, on January 23,

 1995.

 On July 9,

 1993, at 58 Fed. Reg.

36872 the U.S. EPA reinstated these limitations.

 Today’s

proposal adds these pollutants to the regulations.

pollutants previously withdrawn were added to 40 CFR 414.25,

414.35,

 414.45, 414.55,

 414.65,

 414.75, and 414.85.

 The 11

pollutants added are acenaphthene,

 fluoranthene,

 riaphthalene,

bis-(2-ethyl-hyxyl)phthalate,

 di-N-butylphthalate,

diethylphthalate, dimethyl-phthalate,

 anthracene,

 fluorene,

phenanthrene, and pyrene.

Two

pollutants,

 2,4-dimethyiphenol and

phenol, were not included because it was determined that these

pollutants do not pass through POTWS.

19 pollutants were returned to the table

 in 40 CFR 414.101.

The 19 pollutants added to the table are acenaphthene, 2,4-

dimethylphenol,

 fluoranthene, naphthalene, phenol, bis-(2—ethyl-

hexyl)phthalate, di-N-butylphthalate,

 diethylphthalate, dimethyl-

phthalate,

 benzo(a)anthracene,

 benzo(a)pyrene,

 3,4—benzofluor—

anthrene,

 benzo (k) fluoranthene, chrysene, anthracene,

 fluorene,

phenanthrene, and pyrene.

A new section on indirect discharge point sources

 is added

as Section 307.2410.

 This Section incorporates by reference 40

DISCHARGE OF DREDGE MATERIALS

U.S. EPA and the Department of Army

 (Corps of Engineers)

jointly promulgated regulations relating to the discharge of

dredged material.

 These

regulations change the definition of “navigable waters of the

United States” to exclude prior converted farmland.

 U.S. EPA and

Department of Army corrected the effective date of the August 25,

1993 dredge discharge regulations.

These amendments do not effect the Board’s regulations on

pretreatment.

 Therefore,

U.S.

 EPA established effluent and discharge standards for

manufacturers of organic and organo—metallic pesticides in the

Pesticide Chemicals Category under the authority of the Clean

Water Act.

from plant and animal raw materials or by

fermentation processes.

 Discharges of chromium, copper,

 lead,

 nickel and

zinc in “complexed metal—bearing wastestreams”,

listed in Section 307.2491, are not subject to

this Subpart.

7)

 Non—amenable cyanide.

A)

 Discharges of cyanide in “cyanide-bearing

waste streams”, listed in Section 307.2490,

are not subject to the cyanide limitations of

this Subpart if

i)

 the control authority determines that

the cyanide limitations are not

achievable due to elevated levels of

non—amenable cyanide (i.e., cyanide that

is not oxidized by chlorine treatment)

that result from the unavoidable

complexing of cyanide at the process

source of the cyanide—bearing waste

stream, and

ii)

 the control authority establishes an

alternative total cyanide or amenable

cyanide limitation that reflects the

best available technology economically

achievable.

B)

 The control authority shall base its

determination made pursuant to subsection

(b) (7) (A)

 above on a review of the relevant

engineering, production, and sampling and

 analytical information at its disposal,

including measurements of both total and

amenable cyanide in the waste stream.

C)

 The control authority shall set forth its

determination made pursuant to subsection

(b) (7) (A)

 above

 in a written analysis of the

extent of complexing in the waste stream and

its impact on cyanide treatability, based on

the information at its disposal.

D)

 Alternative cyanide discharge limitation

determinations made pursuant to this

subsection are subject to the limitations of

Section 307.1103.

 Provided, however, Section

307.1103 shall not be used to allow a

discharge of total cyanide in excess of that

otherwise allowed by this subsection.

8)

 Allowances for non-metal—bearing waste streams.

A)

 The control authority shall establish

discharge limitations for lead and zinc for

waste streams not listed in Section 307.2490

and not otherwise determined to be “metal—

bearing waste streams”

 if it determines that

the wastewater metals contamination is due to

background levels that are not reasonably

avoidable,

 from such sources as intake water,

corrosion of materials of construction,

or

contamination of raw materials.

B)

 The control authority shall base its

determination made pursuant to subsection

(b) (8) (A)

 on a review of relevant plant

operating conditions, process chemistry,

engineering, and sampling and analytical

information.

C)

 The control authority shall set forth its

determination made pursuant to subsection

(b) (8) (A) above in a written analysis of the

sources and levels of the metals,

 based on

the information at its disposal.

D)

 The control authority may establish

limitations for lead and zinc for non-”metal—

bearing waste streams” for the purposes of

subsection

 (b) (8) (A) above between the

following

levels:

i)

 the lowest level that the control

authority determines, based on best

professional judgement,

 can be reliably

measured and

ii)

 the concentration of such metals present

in the wastestreams, but not to exceed

the applicable limitations contained in
