OF
THE
BOARD

This matter is before the Board on a status report,
filed by
the petitioner on January
5,
1995.
The parties state that since November 1992, they have been
corresponding with the United States Environmental Protection
Agency
(USEPA) regarding the Illinois Environmental Protection
Agency’s
(Agency) interpretation of the regulations cited in
denying Central Can’s permit application.
On May 31,
1994,
a
representative of USEPA informed Central Can that USEPA would
allow a “site—specific state implementation plan
(SIP)
revision”
for Central Can’s coating operations.
Petitioner filed its
petition for adjusted standard with the Board on December 5,
1994.
Pursuant to 35 Ill.
Adm. Code 106.711, petitioner filed
its proof of publication in the adjusted standard proceeding on
December 28,
1994.
The Agency has not yet responded to
petitioner’s petition.
It is anticipated that the petition will
continue to be processed through the statutory and regulatory
timeframes.
The parties continue to believe that if an agreement
can be reached regarding the petition for an adjusted standard as
a site specific SIP revision,
it may not be necessary to proceed
with this appeal.
The status report is accepted.
The Board observes that the
petitioner provided the Agency with a draft of the status report,
but the Agency failed to sign the status report.
The Agency also
failed to file a separate status report.
The parties are ordered
to file additional status reports, either jointly or separately,
no later than June 5,
1995.
The status reports shall include
detailed information on the progress of the case, including an
anticipated schedule for further action in this case and in the
action for adjusted standard.
