Order of the Board:
Deerfield earlier obtained a variance to permit the burning
of elm trees

and one of the conditions
was the submission of a report by October 31, 1971, describing
alternative methods to avoid the need for future open burning.
The Village asks that we extend the period for submitting the
report until February 15, 1972 in order to allow an opportunity
for study by a new Environmental Commission.
We view this as a request for a modification or extension
of our variance, and we think action by us is unnecessary. In
September we adopted new regulations on open burning that establish
a permit program with primary responsibility in the Environmental
Protection Agency to supervise the appropriateness of tree burning.
These regulations make the reporting condition obsolete, and it
need not be followed. The Village should work with the Agency to
work out an acceptable program for tree disposal under the new
regulations. The petition is dismissed.
