    IN THE MATTER OF:
    PROPOSED SITE SPECIFIC WATER
    POLLUTION RULES
    AND
    REGULATIONS
    )
    R81-19
    APPLICABLE TO CITIZENS UTILITIES

    (On Remand)
    ORDER OF THE BOARD
    (by C.A. Manning):
This matter is before the Board on Citizen Utilities of
    Illinois’
    (Citizens)
status report and motion to further defer
    proceedings filed on April
    13,
    1995.
    Citizens requests that the
Board extend the stay in this matter for an additional 90 days in
order to allow the Illinois Environmental Protection Agency
(Agency) sufficient time in which to issue a NPDES permit
consistent with a settlement agreement reached between Citizens,
the U.S.EPA and the Agency in a federal enforcement action.
Citizens states that when the NPDES permit is issued, this docket
    and related variance case,
PCB 85-95, will be moot and will be
    withdrawn.
Accordingly, Citizens’ request of a 90-day extension is
granted and Citizens is directed to file a status report on or
    before July 13,
1995 indicating the status of the NPDES permit,
whether additional time will be required or whether it will be
necessary to proceed with this rulemaking.
    In the event the
permit is issued sooner than anticipated, Citizens
    is requested
to file the appropriate motions withdrawing R81-l9 and PCB 85-95.
    IT IS SO ORDERED.
