    On April
    6,
    1995, Polyfoam Packers Corporation
    (Polyfoani)
    filed an amended petition.
    The filing of an amended petition
    restarts the Board’s decision timeclock.
    Therefore, the decision
    deadline in this matter is now August
    4,
    1995.
    On April
    13,
    1995,
    Polyfoain filed
    a “Request for Expedited Decision”.
    Therein,
    Polyfoain requests that the Board maintain the July 13,
    1995 due date of the original petition.
    Polyfoam states that the
    filing of the amended petition will not delay this matter.
    Polyfoam represents that the attorney for the Environmental
    Protection Agency
    (Agency) concurs in petitioner’s request.
    The Board denies petitioner’s request to retain the due date
    of the original petition.
    However,
    in recognition of the motion
    for expedited decision the Board will proceed to a decision on
    this matter expeditiously, consistent with the Board resources
    and time constraints.
    The Agency recommendation is due within
    30 days of the
    filing of the original petition or any amendment.
    Therefore, the
    Agency recommendation is due on May
    5,
    1995.
    Hearing in this
    matter is currently scheduled for May 15,
    1995.
    Considering the
    date of the scheduled hearing and the Agency’s concurrence with
    petitioner’s request for expedited decision, the Board
    anticipates that the recommendation will be filed prior to May 5,
    1995.
