ORDER OF THE BOARD

This matter

conies before the Board an a “Motion to Amend

Petition” filed on February 23,

1995 by Acme Steel and LTV Steel.

Acme Steel and LTV Steel request to amend the petition to seek

permanent relief instead of an adjusted standard for five years.

The Board hereby grants the motion to amend the petition.

Petitioner has also submitted reports on an instreani fish

survey of the target area of the Calumet River and a temperature

evaluation.

These reports will be included in the record.

A hearing is scheduled in this matter for April

10,

1995.

The Illinois Environmental Protection Agency

(Agency)

filed

its response to the petition on November 28,

1994 along with a

motion to file the response instanter.

The Board grants the

motion to file instanter and accepts the Agency’s response as

filed.

Pursuant to 35 Ill. Adm. Code 106.715 the Agency may

amend its response not later than 30 days subsequent to the

amending of the petition.

Therefore,

any amended response by the

Agency should be filed with the Board on or before March 24,

1995.
