Preliminary Order:
Petitioner seeks to burn landscape waste. Under our new
regulations this is basically a matter to be handled by the EPA
on a permit basis, and the Agency~’saction with regard to a permit
request is not stated. The implication, however, is that the
case does not come within the requirements for issuance of a
permit, presumably that’portion of the regulations recuiring
use of an air—curtain destructor within certain restricted areas.
We therefore assume the petition is a timely response to a permit
denial, subject to refutation at a later date.
The petition seeks two things: to burn without a destructor
until installation of one can be completed, by no later than
December 1; and thereafter to burn, without the destructor, wastes
in excess of its capacity. On the second request a hearing is
hereby authorized. On the first a hearing would exhaust the period
of the variance request, and therefore we shall retain that portion
of the case for decision without hearing upon receipt of the
