ORDER OF THE BOARD

On February 24,
1995 the Union Oil Company of California
(Unocal) filed a petition for variance from 35 Ill. Adm. Code
212.322 Existing Process Sources for particular matter emissions
pursuant to Section 35 of the Environmental Protection Act
(Act)
for its Chicago Carbon Plant.

Unocal’s
facility is located at 317 W. New Avenue, near Lemont, Illinois
and is approximately 30 miles southwest of Chicago.
The Board on March 9,
1995 ordered Unocal to file an amended
petition to provide supplemental information, or any other
appropriate motion, on or before April 14,
1995.
On April
7,
1995 Unocal filed
a motion for an extension of time to file the
supplemental information to May 15,
1995.
Unocal states that it
is negotiating with the Illinois Environmental Protection Agency
and requires additional time to gather the requested information.
The Board grants Unocal’s motion for extension of time to
file an amended petition.
Pursuant to Section 38(a) of the Act
the statutory due date in this case is June 15,
1995,
absent the
filing of an amended petition or
a waiver of the decision
deadline pursuant to 35 Ill. Adm. Code 101.105.

Since the statutory decision deadline will
automatically restart upon the filing of the amended petition the
Board will have sufficient time to deliberate this matter.
If
Unocal fails to file either an amended petition or a waiver of
the decision deadline on or before May 15,
1995 this matter will
be dismissed.
