    This matter comes before the Board on a motion to file
    response instanter filed by the Illinois Environmental Protection
    Agency (Agency)
    accompanied by the Agency response.
    The petition
    was filed with the Board on June 16,
    1995.
    Pursuant to 35 Ill.
    Adm. Code 106.714, the Agency response
    is to be filed with the
    Pollution Control Board within 30 days after the filing of the
    petition.
    The response was therefore due to be filed on July 17,
    1995.
    This motion and the response were filed 59 days after the
    filing of the petition and the response
    is 28 days late.
    The Agency’s motion to allow filing of the Agency response
    instanter
    is hereby granted.
