ILLINOIS POLLUTION CONTROL BOARD
    September 27, 1971
    NILES TERRACE, INC.
    v.
    )
    * 71—280
    ENVIRONMENTAL PROTECTION AGENCY
    Order of the Board:
    This petition seeks permission to connect several new homes to
    a sewer tributary to inadequate sewage treatment facilities in the
    North Shore Sanitary District. It does not allege sufficient facts
    to enable us to grant the variance, even if all the facts alleged
    were proved. As in two cases recently dismissed (Waukegan Park
    Dist. v. EPA, # 71—266 ($ept. 16, 1971); Lake County School Dist.
    * 64 v EPA, * 71—267 (Sept. 16, 1971), we dismiss with leave to
    file a new petition alleging facts that will bring the case within
    our precedents or otherwise qualify for extraordinary relief. See,
    e.g., Wachta v, EPA, * 71-77 (July 12, 1971); Wagnon v. EPA, * 71-85
    (July 19, 1971); Ciancio v. EPA, # 71—100 (August 2, 1971).
    I, Regina E. Ryan, Clerk of the Pollution Control Board, certify
    that the Board adopted the above Order this 27 day of
    September 1971.
