on Motion for Reconsideration:
Mr.
Piroyan’s variance petition regarding connection
to
a
sewer tributary
to an overloaded North Shore Sanitary District plant
was denied by the Board August
5.
He petitions
for reconsideration,
alleging that the impossibility of installing
a holding tank was
a
fact not alleged in the -initial petition and his case is similar
to
#
71-100, Ciancio
v.
EPA,
in which
a variance was granted.
The
cases are not the
same,
for reasons stated in the various opinions
in both cases, and the fact of
the holding tank has no bearing~on
the Board1s~decision.
The case was fully considered
on its merits
the first time around,
and we
see no reason for the extraordinary
remedy of reconsideration.
