ORDER OF THE BOARD (by R.C. Flemal):
On November 16, 1994, St. Louis Auto Shredding (SLAS) and
the Illinois Environmental Protection Agency (Agency) filed a
joint status report pursuant to a October 6, 1994 Board order.
The parties state that they have reached an agreement about the
most significant terms of the closure permit, but are in the
process of finalizing the closure permit details. SLAS
anticipates filing a motion to dismiss this matter in the near
future. The Board accepts the parties’ status report.
SLAS and the Agency also request a new status date. The
parties state that additional time is needed to finalize their
agreement on SLAS’s closure permit. The Board grants the request
for new status date.
The Board directs SLAS and the Agency to file status
reports, or a joint status report if the parties prefer, to be
received by the Board and hearing officer no later than January
30, 1995, in the event that this matter has not already been
resolved and dismissed.
