ORDER OF THE BOARD (by R.C. Flemal):
This matter comes before the Board on a joint status report
filed by the parties on September 12, 1994. The parties state
that they “have reached an agreement about the terms of a closure
permit, but are working out the final details” (Status Report at
1). The parties further state that St. Louis Auto Shredding
expects to file a motion to dismiss this permit appeal in the
near future, after agreement with the Agency is finalized. As a
consequence, the parties ask that the Board order another status
report in sixty days.
However, the Board notes that this matter has a decision
deadline of January 16, 1995 (January 12, 1995 Board meeting).
Accordingly, setting a November status date would not allow
sufficient time for hearing and Board decision absent a waiver of
the decision deadline. The Board refers this matter to the
hearing officer to proceed in accordance with the existing time
schedule. Should the petitioner submit an appropriate waiver of
the decision deadline, the parties may request a new status date
at that time.
