DISSENTING OPINION

(by J. Theodore Meyer):

I respectfully dissent from the majority opinion in this

matter.

For the protection of the Illinois taxpayer, the sooner

that the state effectuates its financial assurance regulations

for landfills, the better prepared it will be.

I see no sense in

delaying the effective date of these regulations.

In addition,

I

agree with the public comment submitted by Browning-Ferris

Industries in that financial assurance regulations should apply

to both public and private facilities.

For the above reasons,

I respectfully dissent.
