Opinion of the Board

Mr.
Currie):
Subsequent to our principal decision
in this
case on March
31,
1971,
we have received an inquiry from the District regarding
the interpretation
of
the portion of our order forbidding new
sewer connections
until
the District complies with the
law and
regulations.
Specifically we are asked whether an existing “service
connection that formerly served
a house, apartment or place of
business that has subsequently been torn down to make way
for
a
new
building”
may
be
used
by
the
new
building
“if
the
estimated
volume
of
waste
does
not
exceed
the
former
volume
from
the
old
building”,
and
whether
it
may
be
used
if
the volume from the new
building
is greater~
Our decision
has raised
a number of important questions which
we shall endeavor to resolve
in variance or enforcement proceedings
as they
are brought before
us.
While
it would
save
time to answer
inquiries such as the present one without waiting
to accumulate
a record in accordance with
the Environmental Protection Act
and
our
procedural
rules,
we think
the
Act
does
not
permit
us
to
render
cx
pane
advisory
opinions
as
to
matters
that
may
be
of
importance to other parties.
We
shall be happy
to consider the
question posed either in
a variance proceeding
or in a motion
to clarify
the order after
the other parties
to
the
case are served
and
given
the
opportunity
to
respond.
