Currie):

This

is

a variance request regarding the open burning of

explosive wastes from a plant near Marion.

We have set

the case

for hearing.

The Agency~srecommendation

is that we dismiss the

petition for failure to allege progress in developing alternative

means of disposal such as the

same company has done

at another

site

and for other alleged insufficiencies.

We think the

issues raised should be explored at the hearing and that no

purpose would be served by

a dismissal

at this

point.

The Agencyts

recommendation

stands as

a warning to the petitioner

of the issues

it must meet in the hearing.

The motion to dismiss is denied.
