    Opinion
    and
Supplemental Ordez .of the Board (by Mr. Currie):
Missouri Portland has requested reconsideration of the
Order of the Board entered on April 14, 1971, in which we
denied the company’s request for a variance to allow it to
continue its operations at Joppa, Illinois, until January, 1972,
before beginning to install air pollution control equipment.
The company now states that new evidence will show that
it can begin immediately to prepare its plant for shutdown in
June, 1971, and to install the control devices so that, upon
resuming operations, it will be able to comply with its
previously approved ACERP and with the earlier Order of the Board.
We commend the company for expediting the process of
installing pollution control equipment and find that’the program
presented in its Petition for Reconsideration complies with the
Board’s earlier order. The company has proceeded with dispatch
to accomplish installation as soon as it can be done. The
Environmental Protection Agency has also advised us that it
too has no objection to the revised program put forth by the
company. No further hearing is necessary.
Therefore, based upon the foregoing findings of
    fact
    it is
the Supplemental Order of the Board that:
    1. Missouri Portland will continue its pre—installation
preparations and will shutdown its operations at said
    plant no later
    than
    June
    7,
    1971;
    2. Missouri Portland will not thereafter reopen
its plant at Joppa, Illinois until it has completed
installation of the precipitator pursuant to its ACERP
and to the Order of the Board
    entered on April 14, 1971.
I, Regina E. Ryan do hereby certify that the above opinion was
approved by the Board on the 12
    of Nay
    ,
    1971.
