On February
16,
1971, th~City
of
Lake
Forest filed
a
petition with
the Board stating that on February
3,
1971,
the Environmental Protection Agency had denied petitioner~s
request
for the issuance of
a permit
to enable construction
of
a sanitary sewer to serve twenty-seven single family
residences located in
the city
and
to connect
the
sewer
to
an interceptor sewer of the North
Shore Sanitary District,
~The petition requests a review of the permit denial aforesaid
and has been docketed
as
an appeal pursuant to Section
40
of
the Environmental Protection Act and section 502
of the Rules
and Regulations
of the Pollution Control Board,
On May
6,
1971,
the Board received
a letter from the
City attorney of Lake Forest advising that the Environmental
Protection Agency had granted the permit for construction of
the sanitary sewer and that the city~srequest for connection
permits had been withdrawn,
The letter requests that the pending
appeal petition be withdrawn without
prejudice.
On the present
state of the record there is nothing
pending
before
the Board
on which it can
act or render
a decision,
It is the
Order of
the Pollution Control Board that
the petition of
the City of Lake Forest be dismissed without
prejudice.
