    On March
    25,
    1995,
    Sherex Chemical Co.
    (Sherex) filed a status
    report pursuant to
    a
    Board
    order.
    Sherex also filed a waiver of the decision deadline through and
    including August
    21,
    1996.
    The Illinois
    Environmental Protection Agency
    (Agency) filed a status
    report on
    April
    1,
    1996.
    This permit appeal
    was filed on October 24,
    1991.
    In a June 16,
    1994 letter to the
    Agency,
    Sherex
    withdrew its
    RCRA Part B
    application.
    Sherex
    indicates that the Agency has
    requested additional
    information to support
    the withdrawal and that the parties continue to
    exchange data.
    Sherex
    indicates that it will withdraw
    its appeal
    upon successful
    withdrawal of
    the RCRA Part B
    application.
    The Agency
    reports that
    it is
    awaiting submittal of soil
    sampling which must be
    completed by July
    1,
    1996,
    with a report on
    the sampling due by September
    1,
    1996.
    The
    Agency
    notes that
    Sherex may be required to file an additional waiver of the decision deadline
    depending on when the sampling
    is
    completed and the
    report submitted.
    Absent an additional
    waiver,
    the Board must decide this
    matter based
    on the record at
    its
    August
    15,
    1996 meeting.
    The Board orders the parties to
    file status reports or a joint
    status report with the Board
    on or before July
    12,
    1996.
