OPINION
AND
ORDER OF THE BOARD
(BY MR. CURRIE):
Mrs. Snetsinger seeks to burn diseased elm trees.
As
in
many similar cases
(e.g., City of Winchester v.
EPA,
#70-37,
February 8,
1971), we find that the need to halt the spread of
disease warrants burning,
subject to appropriate conditions.
Mrs. Helen N.
Snetsir~ger is hereby granted permission
to burn diseased trees or any elm wood on her property
in Lake
Zurich within 90 days of this Order, subject to the following
conditions:
1.
Burning shall be done between the hours of 11:00 A.M.
and
4:00 P.M. on
a day when the wind
is between
5 and
20 miles per hour and from the northeast,
and the
sky
is not overcast.
The burning shall be
accompli,shed
in
as short
a time as possible.
2.
The burning shall be supervised by the local fire
department.
3.
No fuel
of lesser quality than No.
2 fuel oil shall
be used to promote combustion.
