    This matter is before the Board on a November
    6,
    1995
    motion to file the recommendation instanter,
    filed by the
    Illinois Environmental Protection Agency
    (Agency).
    Pursuant to
    35 Ill. Adm.
    Code 104.180(a),
    after the Agency investigates a
    variance petition,
    it is required to make its recommendation to
    the Board on the disposition of the petition within 30 days after
    the filing of the petition.
    The City of Ottawa filed the
    Petition for Extension of Variance on September 29,
    1995.
    The
    recommendation was due to be filed by the Agency on October 29,
    1995 and is therefore
    8 days late.
    The Agency claims it was
    unable to complete its technical analysis and hence the
    recommendation
    is
    late.
    The motion to allow filing of the Agency recommendation
    instanter is hereby granted.
    IT IS SO ORDERED.
