This matter
is before the Board on
a motion for extension of
time to
file the Agency recommendation,
accompanied by
a motion
to file instanter,
filed
by the Illinois Environmental Protection
Agency
(Agency)
on October
13,
1995.
The motion to file
instanter
is hereby granted.
In its motion for extension of
time, the Agency seeks an extension until February
16,
1996 to
file its recommendation
in this matter.
The Agency has
previously
been granted two extensions of time to file its
recommendation,
and the recommendation was therefore due to be
filed September
1,
1995.
In support of the requested extension,
the Agency states
that the petitioner has filed four waivers
of the decision due
date, the latest of which extended the due date
in this matter
until May 17,
1996.
The Agency states that petitioner has
applied for the United States Environmental Protection Agency’s
(USEPA)
X-L Program,
and that petitioner met with the Agency and
interested stakeholders to discuss this application on August
10,
1995.
USEPA is expected to announce the final details
of this
program shortly,
at which time
a second meeting
on petitioner’s
application will
be scheduled.
The Agency states that the requested extension
is necessary
to allow the parties to pursue
a complete resolution of the
issues in this matter, which may include petitioner’s
participation in the X-L Program.
The Agency states that it has
been authorized to represent that petitioner has no objection to
the requested extension.
The Agency’s motion for extension of time to file its
recommendation
in this matter
is hereby granted.
The Agency’s
recommendation
is now due to be filed on or before February 16,
1996.
