DISSENTING OPINION
(by J. Theodore Meyer):
I dissent from the majority order in this matter to note
that the Agency record was filed almost seven months
late.
Recently, several Agency records have been filed well past their
respective deadlines,
some being one or two years late,
without
any further explanation than “the press of Agency business”.
Although
I appreciate that the Agency’s current caseload places a
strain on its resources,
I believe it would be a simple task for
the Agency to communicate within the 14-day deadline why the
record must be late,
and request an extension of time to file
it.
For these reasons,
I respectfully dissent.
