ORDER OF THE BOARD (J. Theodore Meyer):
This matter is before the Board on the parties’ July 14,
1995 Agreed Notion to Request Extension of Time to Set Hearing
Date and to Answer the Complaint. The complaint in this matter
was filed on June 20, 1995. Pursuant to 35 Ill. Adm. Code
103.122(d), Respondent, Pro-Pak Industries, Inc. (Pro—Pak), is
required to file its answer by July 22, 1995. The parties report
that negotiations have begun and ask for additional time to
mediate the issues. The parties also request an extension of the
required hearing time frame from 90 days to 180 days.
The Board grants the parties’ motion for an extension of
time in which respondent files its answer. Pro—Pak must submit
its answer or otherwise plead on or before October 23, 1995. We
also grant the parties request to extend the hearing time frame
requirement from 90 days to 180 days, and direct the hearing
officer assigned to this matter to schedule a hearing
accordingly.
