OPINION AND ORDER OF THE BOARD (BY MR. CURRIE):
This is yet another petition for variance to allow open burning
of limited amounts of material to instruct employees in fire fight-
ing practices. We have, on numerous occasions, held that such
burning, subject to certain conditions, is justifiable (e.g.,
Deere& Co. v. EPA, #70-20, December 22, 1970). We grant the
petition subject to the recommendation of the Agency that the
proposed number of sessions be reduced.
Caterpillar Tractor Company (Aurora Plant) is hereby granted
permission to conduct open burning for firefighting instruction
purposes until October 15, 1971. The number of sessions to be held
shall be limited to a total of six. The petitioner shall file
a report with the Agency by November 30, 1971, describing each
training session. Each description should state the number of train-
ees attending, the types and amounts of combustibles burned, the
date and type of burning, the total duration of burning and smoke
emissions, a description of weather conditions and photographs of
the burning which takes place.
