    ORDER OF THE BOARD (by N.J. Melas):
     
    On March 28, 2002, petitioner the Ensign-Bickford Company (EBCO) filed a variance
    for its explosive products manufacturing facility in Wolf Lake, Union County. EBCO requests
    that the Board grant it a variance from the Board’s regulation at 35 Ill. Adm. Code 237.103 and
    allow it to open burn of explosive waste, to open burn potentially-explosive contaminated waste,
    and to flash equipment potentially containing residues of potentially-explosive materials. EBCO
    is requesting that the variance last until the earliest of either: (1) the Board’s grant of EBCO’s
    petition for an adjusted standard in docket AS 00-5, which is still pending; (2) one year after the
    Board denies EBCO’s adjusted standard petition in docket AS 00-5, or (3) five years from the
    date of issuance of the instant variance.
     
     
    Petitioner has waived its right to a hearing in this matter pursuant to the Board regulation
    at 35 Ill. Adm. Code 104.204(n).
     
     
    The Board will proceed to decision after receipt of the Illinois Environmental Protection
    Agency’s (Agency) recommendation. Unless otherwise ordered by the hearing officer, the
    Agency’s deadline to file the recommendation is May 6, 2002, 45 days after the filing of the
    petition.

    Unless the exceptions at 35 Ill. Adm. Code 104.232(a) apply, the Board’s decision in this
    matter is due 120 days after the petition is filed which is July 20, 2002.

    (2000). The Board meeting immediately preceding the deadline is July 11, 2002.
