Opinion of the Board
(by Mr~Currie):
The City asks
a variance to allow the open burninq one
day per month of dise&sed elm trees~ Because, as we have held
before (e,g~,City of Winchester v, EPA,

1971), burning
is a recognized means of avoiding the spread of
infection, we grant the petition~ However, because past burning
at this site has seriously interfered with recreation at nearby
athletic fields, we require that burning take place when those
fields are not in uses
And because we believe the City should
investigate equipment that will achieve the same ends with less
smoke, we make the variance brief and require efforts in that
direction
ORDER
The City of Naperville
is hereby granted a variance to
conduct open burning,
subject to the following conditions:
(a)
Nothing shall be burned except elm trees and em
trimmings~
(b)
Burning shall take place no more frequent~1ythan one
day per month~
(c)
Burning shall be done at the site
as described in
the petition; between the hours of noon and

p~m~only when
the wind is between
5 and
20 miles per hOur; only when the sky
is not overcast; àn~ywhen the winds are from the east;
and only
when the burning will not interfere with theuse and enjoyment
of the athletic fie1ds~

(d)
No fuel of lesser quality than number two
fuel oil
shall
be used
to promote combustion.
(e)
All burning shall he done under the direct supervision
of a City employee,
(f)
This variance shall expire October
15,
1971.
(g)
By September
15,
1971,
the City
shall report to the
Board and to
the Agency on its efforts to locate
a more suitable
burning site and its investigation into
the use of an air curtain
destructor or other means of reducing emissions,
(h)
This variance automatically terminates upon violation
of any of the above conditions.
